General Voice Over Terms

These Terms & Conditions apply to all voice-over services provided by Sara Beth (“Talent”) to any client (“Client”). These terms are binding when any voice-over services are requested and accepted, either through formal agreement, email correspondence, or invoice acknowledgment.

Hours of Service

Talent operates in EST. Talent will answer calls, texts, emails, and social media messages during 8:30am EST and 7:30pm EST, unless otherwise noted. There may be times when Talent is unavailable due to vacation, but Client will be made aware of any possible conflicts or interruptions. 

Services and Specifications

Scope of Services: Talent will provide professional voice-over services, including narration, character voices, commercial voice-overs, and other vocal recordings as agreed upon.

Recording Quality: Services will be recorded in a quiet, in-home studio using professional-grade equipment. Deliverables will be clean sound files, free of audio effects unless requested otherwise.

Fees, Payment, and Licensing

Service Fees: Client agrees to pay the fee outlined in the individual agreement, email, or invoice. This covers performance and recording, excluding use-based payments, residuals, or royalties.

Payment Terms: A non-refundable deposit is due upon agreement. The balance is payable upon delivery of services.

Late Fees: Late payments are subject to a fee of $100.00 per month on the outstanding amount, 30 days following service delivery.

Use-Based Payments: Client agrees to additional license fees based on the usage of the voice-over work, calculated by frequency, geographical reach, and campaign duration.

Licensing: Upon full payment, Client receives a License Agreement for the use of voice-over recordings. Rights to use are contingent upon this agreement.

Revisions and Retakes

Revision Availability: Talent will be available for revisions for 21 days post-delivery unless otherwise agreed.

Retakes for Errors by Talent: Retakes due to Talent’s errors are provided at no extra charge.

Script Revisions: Charges for script changes post-recording vary depending on the extent of revisions.

Performance Retakes for Undirected Sessions: One round of performance retakes is offered at no cost. Subsequent rounds are chargeable.

Pronunciation Preferences: If not provided in writing, changes required will be billed as revisions.

Credit

Client agrees to provide proper credit to Talent in all applicable media forms, unless a written agreement specifies otherwise. The standard format for credit includes ‘Voice Talent: Sara Beth’ or similar variations using the name ‘Sara Beth’.

Services Not Included

Talent’s services are primarily for recording voice-overs. Additional services like editing, mixing, mastering, or file splitting will incur extra fees.

Termination

By Talent: Termination may occur due to breach of contract, non-payment, or other substantial reasons.

By Client: Client may terminate if Talent fails to deliver as agreed, or for other substantial reasons. Payments for work done up to termination are due to Talent.

Use and Ownership

Perpetuity Rights: Talent grants a non-exclusive license for the agreed purposes, barring AI or machine learning uses without express consent.

Broadcast Work: Rights for broadcast work are limited to the term, scope, and geography specified in the Agreement. Extensions require renegotiation.

Confidentiality

Both parties agree to maintain the confidentiality of proprietary information. This obligation lasts for five years post-agreement.

Additional Provisions

Force Majeure: Neither party is liable for delays caused by events beyond reasonable control.

AI Usage Restrictions: Voice-over recordings cannot be used for AI or machine learning purposes without Talent’s express consent.

Modification and Governing Law: Amendments to these terms require written consent from both parties. The Agreement is governed by the laws of Indiana.
